Terms & Conditions

Overview

Please read these Terms and Conditions. “We,” “us,” and “our” refer to Verity Blue Studio. The term “site” refers to verityblue.ca. The terms “user,” “you,” and “your” refer to site visitors, customers, members and any other users of the site.

Liability

Verity Blue Studio and all content on the website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. We make no warranty or representation as to the availability, accuracy or completeness. Neither us, nor any holding company, affiliate or subsidiary of us, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the products, content or the website or any functionality thereof, or of any linked website, even if Verity Blue Studio is expressly advised thereof. Note: Verity Blue Studio will not be held liable for any illness or damages you may incur despite the use of our face masks. Please read the enclosed documentation and mask usage/care links on the order pages, and make an informed and independent decision prior to purchase and use of our masks.

Sales & Service

We reserve the right to limit quantities available for sale. Verity Blue Studio will inform you if we do not have enough product in stock, and allow you to either cancel your order or substitute another product.

Shipping

If Verity Blue Studio has your product(s) in stock, we will email you a shipping notice confirming that the items will be shipped within one week, and that email is our acceptance of your order. In-stock orders normally ship within 3-5 business days of placing your order. Out-of-stock orders will ship once the item is back on our shelves. Your delivery date will be determined by Canada Post delivery schedules and possible backlogs.

Cancellation Policy

You are able to cancel your order within 48 hours and receive a full refund. At this time, because of COVID-19 and obvious health risks, we will not be taking any returns on products. There are no returns on face coverings or other personal items.

Costs

All costs and taxes are quoted in Canadian dollars. Taxes are included unless other wise noted. We may in our sole discretion add, delete or change some or all of the prices of our products and services at any time without notice.

Return and Refund Policy

Our refund and return policy lasts 30 days. If 30 days have passed since your purchase, we cannot guarantee either a full refund or exchange. To be eligible for an item return, your purchase must be unused, and in the same condition that you received it. It must also be in the original packaging. Several types of goods are exempt from being returned. Perishable goods such as food or flowers cannot be returned. We also do not accept products that are intimate or sanitary goods (including face coverings), hazardous materials, or flammable liquids or gases. To complete your return, we require a receipt or proof of purchase.

Gift Card Terms and Conditions

  • As used in these Gift Card Terms & Conditions (“Terms & Conditions”), a “Gift Card” is a gift card, whether in the form of a virtual e-card or an actual physical gift card, purchased from Verity Blue Studio.
  • A Verity Blue Studio Gift Card can be purchased in any dollar denomination from CAD $20.00 to CAD $200.00. The following forms of payment are accepted for Gift Cards: PayPal, Visa, MasterCard and American Express.
  • A Gift Card can be redeemed only through Verity Blue Studio and may only be used toward the purchase of merchandise or services offered for sale on the Verity Blue Studio website. To redeem a Gift Card, you must enter your gift card ID in the “Gift Card Number” area on the billing info page.
  • If you use your Gift Card to make a purchase at Verity Blue Studio, and your purchase does not exhaust the credit balance on your Gift Card, then you may use the remaining balance for future purchases. If you use your Gift Card to make a purchase at Verity Blue Studio which exceeds the credit balance on your Gift Card, you will have to use another payment method to pay for the remainder of your purchase.
  • If you purchase a Gift Card and request a refund within seven (7) calendar days after purchase, then your refund will be credited to the original payment method.
  • Gift Cards do not expire.
  • Verity Blue Studio will not assess a service fee or dormancy fee with respect to a Gift Card. The price quoted is your cost.
  • A Gift Card cannot be used toward the purchase of a new Gift Card.
  • A Gift Card is not a credit card or debit card.
  • Additional credit cannot be added to a Gift Card after it has been issued.
  • Lost or stolen Gift Cards are replaced (to the extent of remaining balance) with valid proof of purchase.
  • A holder of a Gift Card can obtain balance and other card information at any time by following this link https://verityblue.ca/gift-card-balance and entering their Gift Card number.

Gift Card Activation & Use

Plastic gift cards are currently only sold on site. eGift Cards do not require activation by customers. Recipients of an eGift Card click on a link in the email to retrieve the activated eGift Card. It is important that this link be kept confidential.To redeem a Gift Card, you must enter your gift card ID in the “Gift Card Number” area on the billing info page.

Use of This Site

To access or use the Site, you must be 16 years of age or older. Humans under the age of 16 are prohibited from ordering products without parental consent. Information provided on the site related to products and other information are subject to change. Verity Blue Studio makes no representation or warranty that the information provided, regardless of its source is accurate, complete, reliable, current, or error-free. We are not liable for any inaccuracy, error, or incompleteness in the content, but we will try to do our best to keep things current.

Account Creation

In order to use the Service, you will be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to us will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction. Please read our privacy agreement.

Material Submitted to the Site

You shall not upload, post or otherwise make available on the site any artwork, photos, or other materials protected by copyright, trademark, or other proprietary right without the express written permission of the owner. You shall be liable for any damage resulting from any infringement of copyrights, trademarks, or other proprietary rights, or any other harm resulting from such a submission. For all Materials submitted by you to the site, you automatically represent or warrant that you have the authority to use and distribute materials, and that the use or display of said materials will not violate any laws, rules, regulations, or rights of third parties.

Our Intellectual Property

All intellectual property, including Verity Blue Studio’s copyrighted materials shall remain the sole property of Verity Blue Studio. No license to sell or distribute our materials is granted or implied. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the site or content or intellectual property, without our prior written consent.

Limitation of Liability

You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the site or service.

Third Party Resources

The service may contain links to third party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with Verity Blue Studio. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

Indemnification

You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of Verity Blue Studio, our site or our service. You shall provide us with such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing us with such information, documents, records, and reasonable access to you, as we deem necessary. You shall not settle any third party claim or waive any defence without our prior written consent.

Entire Agreement; Waiver

This Agreement constitutes the entire agreement between you and Verity Blue Studio pertaining to the Site and Service.
